What is FSSAI?

 

FSSAI (Food Safety and Standards Authority of India) is a statutory body that monitors & governs food industries in India. The responsibility of FSSAI is to protect and promote public health through the regulation and supervision of food safety. It is a statutory body established under the Ministry of Health & Family Welfare, Government of India following Food Safety and Standards Act, 2006.

What is FSSAI Licence?

The Food Safety and Standards Authority of India (FSSAI) offers a food license to all food business operators (FBO) in India to ensures that your food is verified chemically and hence is safe to consume.

 

All FBO requires an FSSAI License or Registration. The registration depends upon certain factors like the size of production, managing nature of food business activities, and range of operations.

In the FSSAI Registration process, the FBO will get a 14 digit number. It comprises four sections, each of them providing different information about the food business operator.

 

  1. The first digit signifies that whether it is a registration or a license. 1 is for License or 2 is for Registration.
  2. The next two digits indicate the state/UT/Center.
  3. The next two-digit signifies the year of the start of business.
  4. The next three-digit will signify the designated/registrar officers under whose judicial license/registration comes.
  5. In the case of the Central License, the first digit indicates the state.

 

This 14 digit number has to be added to all food packages.

What are the types of FSSAI Licence?

The FSSAI Licensing system is segregated into three different categories based on the scale of operation of the food business. One is the basic registration and the other two forms of FSSAI Registration.

The three licenses are:

1 FSSAI Basic Registration

2 FSSAI State License

3 FSSAI Central License

 

FSSAI Basic Registration: This license is mandatory for every Petty Food Business Operator like small-sized food product manufacturers, temporary stallholders, marketers, storage unit owners, retailers, or distributors. More precisely, speaking FBO with a turnover of up to 12 lakh per annum can go for the Basic Registration. You should choose to register your business with the basic registration if you are a small-sized food product manufacturer, marketer, storage unit owner, retailer, or distributor. This license is issued by the state government with a tenure of 1-5 years.

 

2 FSSAI State License

All the small to medium size entrepreneurs who are operating as manufacturers, retailers, traders, distributors and having an annual turnover of more than 12 lakhs or more annually (up to 20 Crore Rupees) must obtain a State FSSAI License to continue their business operations. In extension to that, all-grain, cereal, & pulses milling units, no matter their turnover, should have the State FSSAI License. This license is issued by the respective State Government to all those who are a part of the food industry. This license is issued with a minimum of 1 year to a maximum of 5 years validity.

 

3 FSSAI Central License

FBO like large scale manufacturers, retailers, exporters, those who operate with Central Government agencies, seaports, etc and operating in more than one state and covered under schedule 1 of FSS Regulations, 2011 need to have the Central License. Apart from that, FBOs with an annual turnover of 20 crores & more must ought the Central FSSAI License. Issued by Central Government with a tenure of 1-5 years.

What are the Documents required for FSSAI Licence?

Documents required for basic FSSAI registration are as follows:

 

  • Photograph of the food operator business.
  • Identity proof of the Directors ( Voter ID card, Aadhar Card, Passport)
  • Address Proof of the Directors( PAN Card, Voter ID, Driving License)
  • No Objection Certificate by Municipality/ Panchayat
  • No Objection Certificate of Health.

Documents required for State FSSAI License are as follows:       

  • Completed and Signed FORM B by directors or partners.
  • Blueprint of the area allocated along with the operating unit in meters or square meters.
  • List of owners/Directors/Partners.
  • List of all equipment/machines used while processing in layout(especially in case of Manufacturing unit)
  • List of all food and ingredients processed in the outlet.
  • Identity and address proof of directors
  • Contact details of owners
  • An Authority letter with name and address of directors,
  • Authority letter of a nominee by owners who assist officers during the time of tests and inspection.
  • Examined report of water used in food
  • Proof of premises (rent agreement, property papers, etc.)
  • Partnership Deed, MOA/AOA
  • No Objection Certificate or duplicate license from manufactures in case of distributors, resellers, labeling, or packaging unit.
  • FSMS (Food Safety Management System) Certificate or plan.
  • Source of milk in case of dairy products processing units.
  • Source of meat in case of meat products processing unit.
  • No Objection Certificate from Municipality of Panchayat
  • Form IX was completed and signed
  • In case of transportation; No. of vehicle, Certificate provided by Ministry of Tourism, Declaration form in case of Delhi or Himachal Pradesh.

Documents required to obtain Central FSSAI License are as follows:     

  • Completed and Signed FORM B by directors or partners.

  • List of all food and ingredients processed in the outlet.

  • In the case of a Packed or Mineral water processing unit, a Pesticides residue report must be submitted.
  • Proof of premises (rent agreement, property papers, etc.)
  • Partnership Deed, MOA/AOA
  • Non-Objection Certificate or the duplicate license from manufactures in case of distributors, resellers, labeling, or packaging unit.
  • FSMS (Food Safety Management System) Certificate or plan.
  • No Objection Certificate by FSSAI
  • Import- Export Code by Directorate General of Foreign Trade.
  • Declaration form by FSSAI
  • Supporting Proof of the turnover of the company.
  • Source of milk in case of dairy products processing units.
  • Source of meat in case of meat products processing unit.
  • No Objection Certificate from Municipality or Panchayat
  • Form IX completed and signed in case of Nominee
  • In case of transportation; No. of vehicle, Certificate provided by Ministry of Tourism, Declaration form in case of Delhi or Himachal Pradesh.
What are the benefits of the FSSAI Licence?

Obtaining a license can provide the food business with legal benefits, build goodwill, ensure food safety, create consumer awareness, and assist in business expansion. Also, it helps regulate, manufacture, storage, distribution, and sale of import food.

What are the penalties if you do not register for FSSAI Licence?

All the FBOs must follow all the rules and regulations of FSSAI for food quality control. If not, then be ready for penalization by the government.
